Former EPA Attorney Brings Extensive
Experience in Pesticide and Air Quality Issues
Timothy D. Backstrom, former attorney for the U.S. Environmental Protection Agency (EPA)’s Office of General Counsel, has joined Bergeson & Campbell, P.C.
Tim Backstrom has a distinguished career in government service. While in EPA’s Pesticides and Toxic Substances Division of the Office of General Counsel, he was responsible for negotiations with paint and coating manufacturers, which led to the elimination of mercury compounds used in paints and coatings. Tim also supervised extensive litigation involving the chemical dinoseb, including nine federal court actions and four formal administrative adjudications.
While in EPA’s Air and Radiation Division, Tim managed complex litigation involving hazardous air pollutants (HAP) and fuel additives. He also worked on a variety of rulemakings implementing the 1990 Clean Air Act Amendments, including issuance of various emission standards for HAPs, delisting of particular HAPs and source categories, and review of the National Ambient Air Quality Standards for nitrogen oxides and carbon monoxide. Tim was also EPA’s lead counsel in the lawsuit that led to settlement of the omnibus litigation concerning the general provisions for HAP emission standards and individual emission limitations adopted by permit.
Tim holds an undergraduate degree in environmental science from the Massachusetts Institute of Technology and a J.D. with honors from Yale Law School.

Mr. Jacoby has over 34 years of experience in assisting pesticide, insecticide, herbicide, fungicide, antimicrobial, wood preservation, and antifouling paint manufacturers and formulators in the area of environmental science and applications for federal and state pesticide registrations and tolerance petitions. Twenty-five years of his experience were gained at EPA, where he worked in the Office of Pesticide Programs as a Chemist, Product Manager, Senior Staff Member, and Branch Chief. Upon retiring from EPA, Mr. Jacoby joined the consultant firm of Charles, Conn & van Gemert, LLC as Director of Environmental Affairs. In 2001, Mr. Jacoby established his own regulatory consultant business. Mr. Jacoby holds an undergraduate degree in Chemistry from St. Norbert College and an M.S. in Management from Frostburg State University.
Because of his broad registration experience, Mr. Jacoby has been invited to give numerous seminars at major universities in the United States and at scientific and industrial conferences. He has organized national and international symposia for the scientific communities on environmental risk assessments used in registration of pesticides.

Dr. Plamondon has a long and distinguished career, and is well known in the industrial chemical community. As Director of Regulatory Affairs for CERM, Dr. Plamondon was responsible for research and development and new product development activities. He also provided strategic preparation and submission of premanufacture notifications (PMN) designed to avoid Toxic Substances Control Act (TSCA) Section 5(e) consent orders and other adverse regulations. Prior to joining CERM, Dr. Plamondon was a staff scientist at Keller and Heckman LLP. Dr. Plamondon also brings a wealth of experience from his prior positions with Akzonobel Chemicals, Inc, Technology Sciences Group Inc., and Rohm and Haas Company. Dr. Plamondon holds an undergraduate degree in chemistry from Loras College, an M.S. in bio-organic chemistry from the University of California at Berkeley, and a Ph.D. from the University of California at Davis.
Dr. Plamondon has presented at many conferences and professional meetings, e.g., the American Chemistry Council’s Global Chemical Regulations Conference (Living with TSCA), among others, and has written extensively on chemical regulatory matters. James V. Aidala, former Assistant Administrator for the U.S. Environmental Protection Agency's (EPA) Office of Prevention, Pesticides, and Toxic Substances (OPPTS), has joined Bergeson & Campbell, P.C. as Senior Government Consultant, and its consulting affiliate, The Acta Group, L.L.C. as Vice President, Policy and Government Affairs. The announcement was made today by Lynn L. Bergeson, a principal of the law firm.
Jim Aidala has a long and distinguished career in government service, and is well known in the agricultural and industrial chemical communities. Prior to serving as Assistant Administrator for EPA's OPPTS, from March 2000 through the end of the Clinton Administration, Jim served as Associate Assistant Administrator for OPPTS from 1993 to 2000. From 1991 to 1993, he worked on the Subcommittee on Environment, Energy, and Natural Resources in the U.S. House of Representatives, where he was in charge of oversight of EPA's implementation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Toxic Substances Control Act (TSCA).
During his career, Jim was the Director of Policy Development at the Wallace Institute for Alternative Agriculture (1990-199l) and was a policy expert on FIFRA and TSCA at the Congressional Research Service (1983-1990), which is part of the U.S. Library of Congress. Jim also served as a Professional Staff member for the U.S. Senate Committee on Government Affairs, Subcommittee on Energy (1981-1983). He did his undergraduate and graduate studies at the Massachusetts Institute of Technology, Brown University, and Harvard University.
According to Ms. Bergeson, Jim will provide strategic and policy advice to clients on a broad range of agricultural, industrial, and biological product approval and defense matters involving pesticide, toxic substance, endocrine disruptor, HPV testing, cumulative risk, and biotechnology regulatory programs and policy matters.

Susan has more than 18 years of experience in the field of risk assessment, with particular emphasis on exposure assessment. Susan has served as the project manager/senior scientist for a diverse range of risk assessments required under FIFRA, including residential, dietary, and microbial exposure assessments, under Proposition 65, including MADL and NSRL development, and under RCRA, including CERCLA/RCRA hazardous waste site assessment. Susan is well versed in the preparation of individual, aggregate, and cumulative residential and consumer product exposure assessments using deterministic and Monte Carlo techniques.
Susan has a B.S. in Microbiology and Public Health from Michigan State University in 1977. She received an M.S. in Environmental Sciences and Engineering from Virginia Polytechnic Institute and State University in 1986, and a Ph.D. in Environmental Biology and Public Policy from George Mason University in 1996.
Susan has managed and conducted numerous residential and occupational exposure assessments on behalf of clients to assess dermal, inhalation, and oral exposures to humans from pesticide products, such as termiticides; flea and tick products for pets, carpets, and turf; fungicides for turf and home gardens; and indoor and outdoor insecticide fogger products. Before Susan joined Novigen, she held positions with environmental science consulting firms involving the conduct of exposure assessments to support human health risk assessments responding to a wide range of regulatory requirements. She is a member of the Society of Risk Analysis (SRA) and the International Society of Exposure Analysis (ISEA), and is a Counselor for the ISEA. At the SRA, Susan served on the Editorial Board of the SRA Residential Exposure Assessment Project and as post-Chair of the SRA Exposure Assessment Specialty Group.

In TMJ Approval Opens New FDA Era
The February 28, 2001, FDA
Webview notes B&C attorney Michael
Cole's role in winning
approval of the TMJ Implants Fossa-Eminence Prosthesis. According
to Cole, this approval is the first he has seen in 25 years of working
on behalf of clients with the Office of Device Evaluation (ODE) where
FDA stepped back from its "appropriate use" worries and left
them to physicians and patients to decide, based on full disclosure in
labeling of the device's real-world limitations -- including the
availability of no-device alternative therapies. Cole notes that
this "is a striking difference in philosophy." The label
"discloses that a lot of patients have responded without surgery .
. . it describes situations where the doctor arrives at the diagnosis
that surgery may be appropriate, but it doesn't prejudge it." Cole
notes further that Dr. Statland, Director of ODE,
stepped in and, through his involvement, the FDA
granted approval once reasonable assurance of safety
and efficacy had been demonstrated, instead of continuing
to dwell on the possibility of misuse.

For Implant
As noted in the February
27, 2001, FDA Webview B&C attorney Michael
Cole,
working with attorney David Rosen, won approval
of the TMJ Fossa-Eminence Prosthesis, ending a 20-month,
$6 million ordeal for Colorado-based TMJ Implants,
Inc. Although FDA reviewers predicated the partial jaw
joint would never be approved, Cole helped propel the review to its
successful conclusion. The final labeling
of the product now includes more indications than
originally asked for and effectively restores the
device to all of its marketed uses before FDA's
classification process removed it from commerce

Change in Approval Philosophy at FDA's Center for Devices
Bergeson & Campbell, P.C. (B&C)
is pleased with the Food and Drug Administration's (FDA) recent approval
of an implant utilized to treat temporomandibular joint disease (TMD).
This approval -- which B&C was significantly
involved in obtaining -- is notable for a number
of reasons.
It was one of the most controversial applications considered in recent years. At the heart of the controversy were two competing medical philosophies for treating TMD when it is caused by degenerative joint disease. "Traditionalists," represented by the panel members and the Medical Officer in the division, believe that patients with TMD should be treated non-surgically, or not at all, until the disease has progressed so far that a total joint replacement is needed as a "salvage" procedure. Our client, who developed the necessary hardware, expressed the bold view that surgery should be considered earlier in the disease process, to try to avoid a total deterioration of the joint. Instead of waiting to implant a total joint, our client advocated a partial replacement that would relieve symptoms and help preserve natural bone so that it did not have to be removed later.
Often, companies faced with the sort of opposition that this application faced will narrow the intended uses for their products, to make them more palatable to the reviewers. The new indication may be approved, but the use does not square with the way the device is being used by physicians. That leads to "off label" use of the product.
Here, our client held the line, maintaining that the data presented proved a reasonable assurance of safety and effectiveness, and that the proposed labeling would discourage inappropriate use. We took the matter to the new Director of Device Evaluation, Dr. Bernard Statland, who, after hearing all the arguments pro and con, ruled that the division should approve the device. Labeling should be written that constituted full disclosure including the clinical results, the limitations on the data -- including the fact that many patients had been lost to follow-up -- and the cautions needed to prevent or deter inappropriate surgery. Armed with that information, doctors and patients -- not the FDA -- should decide whether to use the device.
The action by Dr. Statland represents a new view of approval. It creates what is a more realistic relationship between FDA and the medical community. In the past, many approval decisions masked the fact that reviewers did not trust the surgeons to use the device as FDA perceived it should be used. Doctors had to find ways around limited availability if they wanted to use a device which in their medical judgment was necessary to treat their patient. If the instant decision is followed in the future, that will change.

Bergeson & Campbell, P.C. is pleased to announce that Michael F. Cole has joined the firm as Of Counsel, effective May 1, 2000. Michael brings a distinguished background in a wide range of matters arising under the Federal Food, Drug and Cosmetic Act. He represents manufacturers of pharmaceuticals, medical devices, and diagnostic products. Michael's practice involves business and regulatory planning to expedite product introduction, strategic counseling regarding marketing applications, and representation in compliance matters, including facility inspections, warning letters, product recalls, and seizures.
Michael received his bachelor's degree from Vanderbilt University, magna cum laude and with honors, in political science. He was elected to Phi Eta Sigma and Phi Beta Kappa and was a Ford Foundation Scholar. Michael received his law degree from New York University, where he was a Root-Tilden Scholar and research editor of the New York University Law Review. He is a member of the D.C. and New York bars. Most recently, Michael was a partner in the Washington, D.C. office of McDermott, Will & Emery, where he practiced in the Health Law Department.
