Lynn L. Bergeson Quoted by Bloomberg Law in Article “First Lawsuit Challenging EPA’s Chemical Test Order Filed”

On May 26, 2022, Bloomberg Law quoted Lynn L. Bergeson, Managing Partner, Bergeson & Campbell, P.C. (B&C^®), regarding a lawsuit filed by a coalition of companies making a solvent that the U.S. Environmental Protection Agency’s (EPA) is examining for possible regulation. The coalition is asking a federal court to overturn an agency order seeking data to understand whether the chemical could harm wildlife. 

Lynn L. Bergeson, managing partner of Bergeson and Campbell PC, which specializes in chemical regulations, said she couldn’t comment on the case’s merits, but suspects other companies or industry groups will intervene in the case.

Her law firm has found it difficult to work with the EPA’s chemicals office to understand changes the agency made in a second round of test orders issued in March and April for multiple chemicals, she said.

“There is significant frustration with the process and EPA’s efforts to engage in meaningful scientific discussion,” Bergeson said. The “lawsuit would appear to suggest others are equally frustrated.”
