On July 7, 2021, Bloomberg Law featured comments by Lynn L. Bergeson, Managing Partner, Bergeson & Campbell, P.C. (B&C®) regarding a U.S. Environmental Protection Agency (EPA) announcement of policies to review the first round of chemical analyses that were performed under the 2016 amendments to the Toxic Substances Control Act (TSCA). The Biden administration is concerned the Trump administration’s policies to examine chemicals’ risks led to conclusions that ignored too many ways the chemicals might harm people or the environment.
Others are concerned that the Biden EPA is complicating matters for companies struggling to adhere to an already complicated law.
“We are as shell-shocked as any,” said Lynn Bergeson, managing partner with Bergeson and Campbell PC, voicing a sentiment heard from other attorneys who work with industries. “The big question is how will EPA get this done, and by when.”
