When the Toxic Substances Control Act (TSCA) was enacted in 1976, the U.S. Environmental Protection Agency (EPA) focused its attention on chemical substances and chemical mixtures, while largely exempting the regulation of chemicals in “articles,” generally meaning finished products or manufactured goods. EPA’s more recent announcement of its intent to regulate chemicals in articles to a much greater extent has caught many in the regulated industries off guard and reflects a significant shift in U.S. chemical regulation policy. This change in policy affects all commercial entities that deal with a physical product, as they must now become familiar with the law, its requirements, and the chemical makeup of their finished goods. IBA Annual Conference, October 30 - November 4, 2022, Miami, FL

The International Bar Association (IBA) Annual Conference was open to both members and non-members of the IBA, with lawyers from over 130 jurisdictions and all parts of the legal profession attending, including lawyers in private practice, in-house counsel, human rights advocates, judges, bar leaders, regulators and government representatives. Environmental Regulation in Practice 2022: New Challenges and Priorities, September 16, 2022, New York, NY and via webinar

NACD Pre-Conference Regulatory Workshop, August 17, 2022, Indianapolis, IN

NACD and Richard E. Engler, Ph.D., Director of Chemistry, Bergeson & Campbell, P.C. (B&C®) offered a special pre-ChemEdge workshop, "Situational Regulatory Awareness – What to Do When a Single Chemical Product Is Subject to Three Major Regulations – TSCA, FIFRA, and FFDCA." Many chemicals regulated under the Toxic Substances Control Act (TSCA) also fall under the Federal Insecticide, Rodenticide, and Fungicide Act (FIFRA) and/or the Federal Food, Drug, and Cosmetic Act (FFDCA). The overlap causes confusion and can lead to severe penalties if not handled properly. This interactive workshop used case studies patterned on real-world events to illustrate how different commercial activities involving chemicals can trigger all three regulations.

TSCA New Approach Methodologies, August 3, 2022, 12:00 p.m. EDT, via webinar

Bergeson & Campbell, P.C. (B&C®) presented “TSCA New Approach Methodologies,” a complimentary webinar featuring Lynn L. Bergeson, Richard E. Engler, Ph.D., James W. Cox, M.S., and Kristie Sullivan, MPH. The 2016 amendments to TSCA require EPA “to reduce and replace” vertebrate animals to the extent practicable, scientifically justified, and consistent with TSCA policies. EPA is also required to “develop a strategic plan to promote the development and implementation of alternative test methods and strategies to reduce, refine, or replace vertebrate animal testing and provide information of equivalent or better scientific quality and relevance for assessing risks of injury to health or the environment of chemical substances or mixtures.” Watch now

The lifecycle of industrial, agricultural, and antimicrobial chemical products, especially those embedded in consumer products, has gained increased public attention. This conference marked the sixth annual Toxic Substances Control Act Annual Conference. Leading panelists reflected on the challenges and accomplishments since the implementation of the 2016 Lautenberg Amendments and where the Toxic Substances Control Act (TSCA) stands today.

26th Annual Green Chemistry & Engineering Conference, June 6-8, 2022, Reston, VA

The American Chemical Society (ACS) presented the 26th Annual Green Chemistry & Engineering Conference, with a “Thinking in Systems: Designing for Sustainable Use” theme. This conference explored how green and sustainable chemistry and engineering contribute to the development and commercialization of products for sustainable use. B&C’s Director of Chemistry, Richard E. Engler, Ph.D., and Ligia Duarte Botelho, Regulatory Assistant, presented a symposium exploring “new chemical bias” and how it continues to pose a barrier to market acceptance of novel chemistry and sustainable thinking.

Capacity development webinar for lawyers on responsible investments in agriculture: African Region focus, May 26, 2022, via webinar

The International Bar Association (IBA) Agricultural Law Section, Advancing Land-based Investment Governance (ALIGN), and the Food and Agriculture Organization of the United Nations (FAO), presented "Capacity development webinar for lawyers on responsible investments in agriculture: African Region focus," a webinar focusing on responsible investment in agriculture in the African geographic region. Utilising the contributions of the Committee on World Food Security Principles for Responsible Investment in Agriculture and Food Systems (CFS RAI Principles) and the Voluntary Guidelines on the Responsible Governance on Tenure (VGGT), attendees gained a better understanding of their application in everyday legal work related to investments in agriculture for the African region.
