Program faculty covered the impact of recent court decisions, new regulations, and enforcement initiatives on regulated entities, with an emphasis on providing practical suggestions for management of environmental risks and compliance obligations. Regulators are looking at the entire product lifecycle, including post-discard of product at the end of its useful life, as well as toxicity data. Lynn L. The Environmental Law Institute (ELI), the George Washington University Milken Institute School of Public Health, and Bergeson & Campbell, P.C. (B&C®) held a one-day conference providing updates and insights regarding year three of the federal government’s implementation of the Frank R. Lautenberg Chemical Safety for the 21st Century Act that amended the Toxic Substances Control Act (TSCA) on June 22, 2016. Speakers provided an overview of the current state of TSCA implementation, ongoing and emerging issues, and related developments. Afternoon breakout sessions invited all participants to discuss current law and policy issues.
This conference (in-person and webinar) was free and open to the public, but registration was required, at the ELI website.
The third annual Chemical Watch Expo was a two-day event for regulatory professionals from around the world to take part in practical, topical workshops and to seek their next service to help with chemical regulatory compliance throughout the supply chain. “The New Toxic Substances Control Act - What All Lawyers and Consultants Need to Know,” part of the ABA's Section of Environment, Energy & Resources Law (SEER) Essentials series, provided the basics of the U.S. Toxic Substances Control Act (TSCA) and was essential for all practitioners operating in the chemicals and chemical products space. The new TSCA has many implementation steps and phases; knowing what these are is essential to staying both compliant and competitive. Lynn L. Bergeson, Managing Partner, Bergeson & Campbell, P.C. (B&C®), moderated the program.
Bergeson & Campbell, P.C. (B&C®) and Bloomberg BNA were pleased to present “Chemical Regulation After the Mid-Terms: What We Can Expect to See in 2019,” the fifth and final webinar in the 2018 Chemical Policy Summit Series. The mid-term elections fundamentally changed the balance of power on Capitol Hill, and the result will have a significant impact on chemical regulation and environmental matters generally. The Democrats are now firmly in control of the House, and Congressional oversight will be in high gear. The House is widely expected to launch a dizzying number of investigations, almost certainly some of them related to the U.S. Environmental Protection Agency’s (EPA) positions on climate change, the role of science, ethical lapses, and deregulation in general. The use of subpoenas is also expected to be in full display this year. House and Senate leadership in key Committee assignments will change and so also will the personalities, tone, and content of Congressional oversight of and priority setting related to chemical and other environmental matters. (B&C®), presented Law & Policy of Products Regulation, examining the regulation of chemicals that are used in industrial and consumer products, as well as pesticides, and describing the new governance and stewardship initiatives being considered globally by a wide variety of stakeholders to diminish the potential for adverse effects from chemicals.
