For decades, the Toxic Substances Control Act (TSCA) has been regarded as a “chemical producer” law that retailers, product manufacturers, and other “article” manufacturers could, for the most part, comfortably ignore. Not anymore. TSCA was significantly amended in 2016, and the U.S. Environmental Protection Agency’s implementation of “new TSCA” has drawn many, often unsuspecting, entities in the value chain -- including retailers -- squarely into TSCA’s broad reach. The “new normal” may not be what you want, but this webinar told you what you needed to know.

Recent changes in federal regulations include the Worker Protection Standards under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), which expand the requirements for protecting agricultural workers from pesticide exposure. The Environmental Law Institute (ELI) presented "Pesticides, Farmworkers, Industry, and Environmental Justice," exploring the challenges in implementing these new obligations, from both logistical and pragmatic perspectives. James V. Aidala, Senior Government Affairs Consultant, Bergeson and Campbell, moderated this discussion.

Join the National Association of Chemical Distributors (NACD) and Bergeson & Campbell, P.C. (B&C®), for a Virtual Toxic Substances Control Act (TSCA) Hot Topics Regulatory Workshop. The workshop was held in two-hour interactive online sessions August 11-13, 2020, and presented by regulatory experts from B&C, including Managing Partner Lynn L. Bergeson, Director of Chemistry Richard Engler, Ph.D., and Senior Regulatory Consultant Kathleen Roberts. The workshop began with a review of TSCA and covered current hot topics including Significant New Use Rules (SNURs), the high-priority chemical risk evaluations and industry fees, Chemical Data Reporting (CDR), and more. Participants were able to ask questions of the presenters following each topic. At the end of the workshop, participants joined break-out rooms divided by topic to discuss what was learned and share their experiences.
