US/Global Biocides (Antimicrobials) Regulation Conference, September 25-26, 2014, Washington, D.C.

A two-day Conference that brought together experts from the USA and Europe to discuss latest developments in the regulation of Biocides. The first day covered new developments in the US, including: “New Data Requirements for Antimicrobials (implementation of 158W),” “Efficacy Testing for Public Health Products,” “Testing – the Rise of Alternative Approaches,” and “Food Contact and Antimicrobials.”

Day two of the conference looked at global developments in the regulation of biocides. Countries and legislation covered included Canada, Europe and the BPR, and Asia. The conference closes with a workshop covering the challenges of working in a global market and will include cross-comparisons between the European Union, the US and China.

Burchi will gave a presentation on Sept. 26th on “US Industry View of the BPR from First Years of Implementation” including first experiences with product authorization, clarifying treated articles status, active substance suppliers, data sharing and compensation challenges and comparison to FIFRA, and the status of guidance. EPA's Supplemental Distribution Enforcement Actions Are Buzzing: How to Avoid Getting Stung, July 23, 2014, Washington, D.C.

The U.S. Environmental Protection Agency (EPA) has made good on its intent to focus enforcement efforts on Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) supplemental distribution, resulting in several settlements with significant penalty assessments. B&C recently issued a memorandum discussing the enforcement actions, the regulatory requirements for supplemental distribution, and what issues companies should address to help avoid such an enforcement action. That memorandum is available online.

As a further service to clients and friends, B&C presented a complimentary webinar highlighting the most important steps that both registrants and supplemental distributors can take to ensure compliance and avoid being stung in the current heightened enforcement environment. Speakers included B&C’s Lisa R. Burchi and Sheryl L. Dolan, and attorney Jon Jacobs, a 25-year veteran of EPA’s Office of Enforcement and Compliance Assurance who has recently entered private practice. Their 45–minute presentation was followed by Q&A with webinar participants.

Webinar: EU Biocidal Products Regulation (BPR): What it Means for Industry and How it Compares to U.S. Regulation, April 30, 2014, 1:00pm - 2:30pm

The European Union Biocidal Products Regulation dramatically changes the way biocidal active substances and products, as well as many products not traditionally considered biocidal products, are regulated under European law. Practical aspects of this new regulatory system are subtly different from those in other jurisdictions, EU neighboring countries, and the US. Companies exporting to the EU as a component of their global business must ensure that their supply chains and product designs are compliant with the regulation.

The webinar, presented by Bloomberg BNA and featuring Andrew R. Bourne, Lisa R. Burchi, and Lara A. Hall, was focused on existing industry norms and explore how current standard practices are affected by the new developments in EU biocides regulation. The current trends in the EU biocides regulatory landscape will be compared to the U.S. system (the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)), and the time and practical steps necessary to bring a product to market in the U.S. and EU were contrasted. 1.5 hours of CPE or CLE credit. The fourth webinar in the series “Entering the Marketplace: Public and Private Product Regulation at Home and Abroad,” examined product marketing laws and policies, including green claims, administered by EPA, FTC, and states under consumer protection laws, such as FIFRA.
