Lynn L. Bergeson Presents “TSCA Implementation and Current U.S. Regulatory Environment” at NIA Webinar
On May 24, 2017, Lynn L. Bergeson, Managing Partner at Bergeson & Campbell, P.C. (B&C®), presented “TSCA Implementation and Current U.S. Regulatory Environment” at the Nanotechnology Industries Association (NIA) webinar: “Toxic Substances Control Act (TSCA) implementation and current US regulatory environment.” Ms. Bergeson’s presentation addressed reformed TSCA (Frank R. Lautenberg Chemical Safety for the 21st Century Act) implementation and the current regulatory environment under the Trump Administration and U.S. Environmental Protection Agency (EPA) Administrator Scott Pruitt. She explained that while the stopgap spending bill recently passed by Congress does not make huge cuts (approximately one percent of total spending), Trump’s proposed budget would diminish EPA’s funding by almost one-third, 31 percent. This would scrap over 50 programs and cause a workforce reduction of 20 percent, meaning a significantly different regulatory environment for many industries. On the topic of TSCA reform and implementation, Ms. Bergeson highlighted changes to Section 4, giving the EPA expanded authority to order companies to use health and environmental testing to aid assessments of chemical risks, Section 5 new chemical review, Section 6 risk reviews of existing chemicals, as well as other key TSCA changes. Ms. Bergeson ended the presentation by emphasizing evolving key TSCA issues such as risk evaluation under TSCA Section 5 and Section 6, confidential business information, and EPA’s expected industry fees proposal.
