ABA Publishes “The RCRA Practice Manual,” with Chapter on Hazardous Waste Co-Authored by Lynn L. Bergeson and Christopher R. Bryant

The American Bar Association (ABA) Section of Environment, Energy and Resources has published the third edition of “The RCRA Practice Manual.” The Manual focuses on the “cradle-to-grave” program for managing hazardous wastes under the Resource Conservation and Recovery Act (RCRA), and is a comprehensive yet easy-to-use guide to an extraordinarily complex area of environmental law. Each chapter of this updated edition has been re-written to reflect the numerous developments and changes that have resulted in new RCRA judicial and regulatory interpretations.

Lynn L. Bergeson, Managing Partner of Bergeson & Campbell, P.C., and Christopher R. Bryant, Senior Regulatory Consultant at Bergeson & Campbell, P.C., are among the esteemed contributing authors, co-authoring Chapter 4, “Definition of Hazardous Waste,” which summarizes how the U.S. Environmental Protection Agency (EPA) identifies those solid wastes that are hazardous wastes, and provides valuable insight and advice for RCRA practitioners. Ms. Bergeson and Mr. Bryant write with depth and detail on solid and hazardous waste exclusions, hazardous waste exemptions, requirements for recyclable materials, listed hazardous wastes, delisting hazardous wastes, characteristic hazardous wastes, the Toxicity Characteristic Leaching Procedure (TCLP), the mixture and derived-from rules, and the contained-in policy, mixed waste exemption, universal waste rule, and residues of waste in empty containers.

Ms. Bergeson works with corporations and a wide range of trade associations on evolving regulatory and policy matters pertinent to products of conventional chemicals, biotechnology, biobased chemicals, nanotechnologies, and other emerging technologies, particularly with respect to Toxic Substances Control Act (TSCA), Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), RCRA, Food Quality Protection Act (FQPA), Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), and Occupational Safety and Health Administration (OSHA) matters. She is a former chair of the ABA Section of Environment, Energy and Resources and was a contributing author to the following ABA books: “Nanotechnology: Environmental Law, Policy, and Business Considerations” (2009), “The TSCA Basic Practice Book” (2000), and “The FIFRA Basic Practice Book” (2000). Mr. Bryant has more than 20 years of experience in environmental, health, and safety (EHS) compliance and legislative, regulatory, and policy issues. Prior to Bergeson & Campbell, P.C., he was director of the Chemical Products and Technology Division at the American Chemistry Council, assisted General Electric in the development and implementation of its EHS management systems, and was the director of EPA’s RCRA/Superfund Industrial Assistance program.
