On August 22, 2022, Bloomberg Law quoted Lynn L. Bergeson, Managing Partner, Bergeson & Campbell, P.C. (B&C®), regarding an announcement that the U.S. Environmental Protection Agency (EPA) plans to more closely analyze new chemicals to better understand the extent to which they’ll get into the environment, where people might breathe, touch, or ingest them.
Lynn L. Bergeson, managing partner for Bergeson & Campbell PC, which specializes in chemical laws, described EPA’s announcement as “very unexpected.”
“Without notice or consideration from the regulated community, EPA seems to be saying, decades of practice has been discarded in favor of a presumption that all exposures are meritorious of EPA review, no matter how trivial, and will require EPA modeling. I am hard pressed to understand how this will not burden the program, but also undermine the scientific integrity of prior EPA new chemical review determinations,” said Bergeson, whose law firm counsels the Toxic Substances Control Act New Chemicals Coalition.
