Lynn L. Bergeson Referenced In Bloomberg BNA Daily Environment Report Article “Updating TSCA, Spurring Safer Chemicals, Increasing Markets Among Priorities in 2015”

Comments made by Lynn Bergeson were published by Bloomberg BNA Daily Environment Report in an article about recent and continuing efforts to pass a Toxic Substances Control Act (TSCA) reform bill.

Federal preemption of state chemical regulation purposely was not addressed in a widely circulated draft revision of S. 1009 that never was introduced, and the preemption issue remains a challenge, Lynn Bergeson, managing partner of Bergeson & Campbell P.C., told Bloomberg BNA in an e-mail.

The circulated draft did, however, include deadlines for the Environmental Protection Agency to achieve specific chemical management objectives and compromise language on challenging issues such as the law’s risk standard, toxicity test requirements and confidential business information, she said.

While the draft did not resolve differing perspectives on what the law should cover, it did provide a solid jumping-off place for continuing to work on resolving them, she and others told BNA.
