Signs Federal Register Notice Concerning EDSP Test Orders

Bergeson & Campbell, P.C.

At yesterday’s Pesticide Program Dialogue Committee meeting, Steven Bradbury, Deputy Office Director for Programs, U.S. Environmental Protection Agency (EPA) Office of Pesticide Programs, announced that Steve Owens, Assistant Administrator of the EPA Office of Prevention, Pesticides and Toxic Substances, would be signing later in the day the Federal Register notice concerning the schedule for sending out test orders for the final list of chemicals for initial Tier 1 Screening under the Endocrine Disruptor Screening Program (EDSP).  Under the EDSP, recipients will have 90 days to tell EPA how they intend to act on the order, and 24 months in which to conduct the tests.  Potential responses include providing existing data, voluntarily canceling their registration, and reformulating products to avoid a listed chemical.  EPA’s final list, which it announced on April 15, 2009, includes 67 pesticide active ingredients and high production volume chemicals used as pesticide inert ingredients (also known as other ingredients).  The Federal Register notice is not yet public, though reportedly a pre-publication copy will be available on the Internet by tomorrow.  More information on the EDSP is available at http://www.epa.gov/endo/.
